CLARITY Act Fails to Advance in U.S. Senate

The United States has been working towards a clearer regulatory framework for digital assets, with the Digital Asset Market CLARITY Act emerging as one of the key pieces of legislation in this effort. The bill seeks to establish clearer rules for digital assets and define the respective regulatory responsibilities of the Securities and Exchange Commission (SEC) and the Commodity Futures Trading Commission (CFTC). However, the legislation faced a major setback in the U.S. Senate on September 15, 2026, when lawmakers didn’t approve the procedural motion required to move the bill forward.

What Happened With the CLARITY Act?

  • On September 15, the U.S. Senate voted on a motion to move the CLARITY Act (H.R. 3633) forward for further consideration.
  • The motion failed by 49 votes to 50, below the 60-vote threshold needed for the bill to proceed under the Senate’s cloture process.
  • The vote came shortly after Senate Republicans unveiled an updated version of the bill on September 14, featuring 126 substantive revisions covering different areas.
  • The setback means the proposed federal framework for digital asset regulation remains unresolved, including the division of oversight responsibilities between the SEC and CFTC.
  • Although the revised bill didn’t receive sufficient backing in the procedural vote, the outcome doesn’t permanently end the legislation’s legislative process, leaving room for lawmakers to receive it.
